Outchat (“Outchat,” “we,” “us,” or “our”) is committed to safeguarding your privacy. This Privacy Policy applies to your use of our Services and website www.outchat.com. It describes the types of information we collect, how we process it, and why.

Outchat is a product of The Remote Company, Inc., a corporation incorporated under the laws of Delaware (228 Park Ave S, PMB 54955, New York, New York 10003-1502, United States of America).

1. Definitions

1.1. "Controller" means an entity that determines the purposes and means of the Processing of Personal Data. 1.2. "Customer" means a person or entity that is rendering the Services from Outchat. 1.3. "Data Protection Laws" means all data protection and privacy laws and regulations of the EU, EEA and their member states, Switzerland and the United Kingdom, applicable to the Processing of Personal Data. 1.4. "GDPR" means the Regulation (EU) 2016/679 of the European Parliament and the Council of 27 April 2016. 1.5. "Personal Data" means any information relating to an identified or identifiable natural person. 1.6. "Processing" means any operation or set of operations performed upon Personal Data, whether or not by automated means. 1.7. "Processor" means a natural or legal person, public authority, agency, or other body which Processes Personal Data on behalf of the Controller. 1.8. "Services" means any services provided by Outchat to its Customers. 1.9. "Visitor" means a person visiting the website of Outchat.ai. 1.10. “We”, “us”, and “our” refer to Outchat. 1.11. "You," "your," and "yours" refer to the user.

2. Consent

By using our Services or visiting our website, you consent to the collection, storage, use, and disclosure of your personal information as described in this Privacy Policy. We provide jurisdiction-specific notices (EU/UK GDPR, U.S. state privacy laws, and other applicable frameworks) at or before the point of collection. We honor Global Privacy Control (GPC) signals as valid opt-out requests under California law.

3. Information We Collect

  • Personal Data: account info, organization info, IT data, client data provided by Customers.

  • Visitor Data: IP addresses, cookies, browser data.

  • Non-Personal Data: device/browser details, demographics, usage trends.

  • Service Data: aggregated information about system performance, reliability, and usage patterns, which we use to improve and secure the Service.

4. Purposes of Processing

We process data to provide and maintain the Service, authenticate and manage accounts, process payments, communicate, ensure security, comply with law, and improve/analyze Services. Legal bases under GDPR include: contractual necessity, consent, legitimate interests, and compliance with legal obligations.

5. How We Collect Data

  • Direct from Customers.

  • Cookies & similar technologies (non-essential cookies require prior consent in the EEA/UK; manage preferences in our Cookie Settings Center).

  • Third-party services (analytics, advertising).

  • Automated logs (IP addresses, browser, device info).

6. Sharing with Third Parties

We never sell Personal Data. We may share it with hosting, analytics, and payment providers, sub-processors, and legal authorities. We maintain a public list of authorized sub-processors and provide advance notice of material changes.

You may receive service-related emails. Marketing emails require consent and include opt-out options.

8. Data Security

We apply encryption, access controls, ISO 27001-certified hosting, and incident response. While we take reasonable and appropriate measures aligned with industry standards, no method is 100% secure.

9. Retention

  • Account data: life of account + 2 years.

  • Billing: 7 years.

  • Analytics: 14 months.

When data is no longer needed, we delete or securely anonymize it in accordance with retention schedules and backup deletion cycles.

10. International Transfers

Transfers outside the EU/UK rely on Standard Contractual Clauses (2021/914/EU) with supplementary safeguards.

11. Children’s Privacy

Outchat is not directed to children under 13 (U.S.) or under the applicable digital consent age in the EU/UK (typically 16, may be as low as 13 depending on the country). We do not knowingly collect such data. If discovered, we delete it unless parental consent is provided.

12. Your Rights

Depending on jurisdiction, you may:

  • Access, correct, or delete data.

  • Request portability.

  • Object to processing or withdraw consent.

  • Opt out of sale/sharing of data. Submit requests at: info@outchat.ai. We verify identity before processing requests.

13. CCPA/CPRA Notice

California residents may request disclosure, deletion, correction, and opt-out of data sale/sharing. We honor GPC signals.

14. Business Transfers

In mergers/acquisitions, your data may be transferred to a successor entity.

15. Changes

We may update this Privacy Policy. Notice will be provided via email or website.
